TQI Payment & Collections Policy

This policy specifies specific actions on the part of TQI and TQI Clients as it relates to use of TQI services. TQI reserves the right to invoke or modify these policies at any time without notice to stay in compliance with any laws, regulations, business and security requirements. By using TQI services, every Client and user unconditionally accepts the terms of these policies.

This Payment and Collections Policy is divided into five sections:

I.     Payment and Collections Policy Overview 

This document represents the billing, payment and collection policy of TQI effective January 1, 2018 for all services performed prior to this date and thereafter. It is the policy of TQI to manage its financial affairs in a competent businesslike manner. In order for operating expenses and capital projects to be planned and accomplished, it requires that invoices be paid promptly. TQI believes it is important that payment discipline be maintained not only to assure its financial security, but also to eliminate any inequities that may arise when prompt payment of invoices does not occur. These payment and collection policies were established for the financial protection of all our customers, and are intended to encourage timely payment.

II.   Payment Terms for Subscription Services   

  1. According to terms of all TQI agreements, subscription services for software, hosting and design are due no later than the 1st day of every month with or without an accompanying invoice. It is the responsibility of each Client to ensure the prompt payment of subscriptions no later than this date. It is the responsibility of the Client to know and understand the terms of their signed agreement for subscription services.
  2. Subscriptions are considered to be past due on the 2nd day of each month and shall be subject to administrative fees and interest charges if received later than the 1st day of the month. To defray the costs of administering the account an administration fee of $25.00 shall be charged in addition to interest which shall accrue at 1.5% per month on the unpaid balance. The administration fee and interest shall be charged for each month any overdue balance remains unpaid. Payments shall be applied first to costs of administration, next to interest and the remainder to reduce principal. If any portion is not paid, additional administrative fees and interest charges will continue to accrue.

III.   Payment Terms for Non-Subscription Services  

  1. All non-subscription service invoices are due upon receipt and considered past due after 20 days after receiving.
  2. Terms for invoices of non-subscription services are Net 20 Days from the date of issuance. A $15.00 invoice fee shall be required for each paper invoice requested and a $15.00 check fee will be charged for each payment made by check effective March 1, 2018.
    1. No discounted terms shall be provided for any Client in the event any invoice is past due for subscription services.
  3. Non-subscription invoices are considered to be past due on the 21st day after receiving the invoice. All past due payments shall be subject to administrative fees and interest charges. To defray the costs of administering the account an administration fee of $25.00 shall be charged in addition to interest which shall accrue at 1.5% per month on the unpaid balance. The administration fee and interest shall be charged for each month any overdue balance remains unpaid. Payments shall be applied first to costs of administration, next to interest and the remainder to reduce principal. If any portion is not paid, additional administrative fees and interest charges will continue to accrue.
  4. It is the Client’s responsibility to maintain current and accurate e-mail accounts for electronic billing and/or PO boxes and mailing addresses.
  5. While TQI has initiated many procedures to alert Clients with respect to outstanding balances, ultimately it remains the Client’s personal responsibility to make prompt payment of balances due.

IV.   Penalties for Late Payment / Insufficient Funds / Chargebacks          

  1. There is a $70.00 fee for all returned checks.  If we receive a returned check, you must pay the balance, including the fee and any administrative fees and interest associated.
  2. No discounted terms shall be provided for any Client in the event any invoice is past due. 
  3. Should a Client remit payment for a past due account without adding the administration fees or interest to their payment, the invoice shall still be open and administration fees of at least $25.00 per month shall continue to accrue until the invoice is completely paid in full. Payments shall be applied first to costs of administration, next to interest and the remainder to reduce principal.
  4. TQI reserves the right to require an up-front payment for any new deliverables on accounts. 
  5. TQI may automatically and without notice terminate a Client account in the event a Client declines, reverses, cancels or charges back (“Chargeback”) a credit card, ACH or check for payment. If you have questions or desire to dispute a payment, we encourage you to follow the Dispute Policy which is referenced in every Master Agreement, SOW and invoice.   6. Unfortunately, there are a small percentage of Clients who may allow outstanding balances to exceed 50 days. This negatively impacts cash flow; the fiscal health of our company and it threatens our Clients whose accounts are in good standing. Any Client account (made up of balance due, administration fees and interest fees) which remains unpaid for 30 days past the last date it was due (Net 20) is considered to be 50 days in arrears and the account shall be sent to collections.

V.    Collections & Service Suspension Process

  1. Please note that effective December 31, 2017, in the event a Client fails to remit payment in full after 60 days, TQI may suspend all services and report Client’s payment history to credit agencies without notice. Client shall be responsible to pay set up fees to reinstate their account(s). TQI shall not be liable for any reason upon suspension of services if a Client loses a domain name or names, fails to receive income or investments, experiences negative public relations or has their account submitted to collections because of Client's failure to make payment in full to TQI for services rendered.   2. In addition, TQI reserves the right due to Client’s failure to remit payment in full after 60 days to disconnect the Client's hosting and support services, e-mail, e-Commerce, make the Client's website(s) unavailable, and/or not renew Client's domain name(s) until FULL payment is made to TQI in connection to past due account(s). When payment is received by TQI and verification is made by TQI’s bank; Client's services shall be restored. TQI does not offer payment schedules on past due accounts.
  3. When a Client account balance is 70 days in arrears the account may be forwarded to TQI’s legal counsel for collections. TQI shall hold Client responsible for all costs pertaining to the collection of the outstanding balances including attorney fees, necessary filing fees, and collection agency expenses.
  4. Failure to use your account and/or moving your domains, website or other related hosting to another provider does NOT constitute a cancellation of services with TQI. Established agreements outline how agreements are to be disputed or cancelled, as well as, the Client responsibilities regarding the process.
